Yes no doubt about it, because the institutions like the election commisison should not only be impartial, but also appear to be impartial. It served notice and expected a detailed reply within 24 hours and decided in another 24 hours, even if it was a sunday, see the speed with which it disposed off the case, where as there is a case of Ansari pending who had spoken ill of Hindus at Chandigarh, but he has only been served notice no action forthcoming. Sanjay dutt is fighting election, the E C didnot seem fit to 'GUIDE " the S P not to give ticket to him, Azarudin who is, as everyone knows, a player who sold the repute of the nation for match fixing and who did not even care for his wife of child, and the election commissiion is not GUIDING the congress party, about him.

So even though the it may appear to be on the right side, the E C appears to have surely have exceeded its authority

The EC HAS EXERCISED ITS ADVISORY FUNCTION SO FAR.THE LEGAL CATEGORICAL ORDER MAY BE PASSED ON HIS CANDIDATURE WHEN HE COMES TO FILE HIS NOMINATION.BOTH PARTIES CAN APPROACH THE COURT THEREAFTER.
