Article 356 of the Indian Constitution has acquired quite some notoriety due to its alleged misuse. in many cases this article was invoked to fulfill the nefarios intentions of the party in the central govt virtually going against the intent of the constitution. SC judgement in the S.R.Bommai case and the Sarkaria Commission report in this regard should be consulted
Art.356 is a provision that has been abused by successive governments at the Centre to dismiss the governments in the states, especially those which donot belong to the same political party that rules are the centre.
This provision can be applied/invoked only in cases when it is reported by the governor of that state in his report to the president that the state government cannot be carried out in accordance with the constitution. Implying that there has been a breakdown in the constitutional machinery in the state. What amounts to such break down has not been detailed in the constitution.
Hence it has been most abus ...more
