Dear Ashwin,

The right to strike has been granted by Industrial Disputes Act,1947 and has the support of Article 19 of the Indian Constitution. If you look at the objective of both the Act and our Constitution strike per se is not bad and is a peaceful form of protest by a group of people against any exploitative laws in force as a last resort. It can be done against the Government, Organisation or Statutory Bodies. Even Mahatma Gandhi's Civil Disobidience is a form of Strike.

Now, any violence, coersion, intimidation and arm twisting by Unions should not only be banned but strict action like termination,
or even Criminal Proceedings should be carried on and the acts should be classified in the same category as riot, loot, arson.

What you must present is that Strike should be dealt by the causes and the manner in which it was implemented by Unions.

Strike is our right but one should see that the property is not destryoed at this time as in Japan they keep their machine and other things totally intact so that when the strike is over they cand do just the double work

If u ban strikes, workers will solve their grievences by hooking up w/ "Dawood bhai" or any number of aspiring Dawood bhais nationwide.

People don't strike because they got bored out of watching FTV....but they strike when something is seriously not rite. Now...often times in strikes, the fault is not w/ the labourers and neither is it w/ the owners...but coming from some down to the earth experience boss, 99.95% of ALL strikes are caused by MANAGEMENT who miscommunicate info & dealings between workers & the owner(s) / directors.

In many cases, strikes happen when you have a manager in need of a quick buck. Certain elements management tish workers on one end saying that the directors are on the verge of bailing, and you have the same management telling directors that the labourers are planning on intensifying the agitation.

Then when u call the police...on one end they give a "why are you negociating w/ these riff raffs. Just give us the word and it will be latties galore" ...more

Every body has posted long answers. I will just say that for better development of the country and we should have labour laws which protects interest of both side which is not in present senario and it cannot be untill we have good government who will understand the problem of enterpreneaurs, strikes and also public holidays should be banned for allround development of nation
