Read the news correctly. The Supreme Court has rejected a PIL that was filed in support of the Chief based on the opinion expressed by former Chief Justices of the Supreme Court. The case is yet to even come up for hearing and has not been listed yet for a specific date.

The right decision....his petition was not in consonance... undignified to his rank
I was surprised...shocked by the flimsy reasons he had given for going to court...
publicising a fact which should have remained in the army office domains...
setting a bad precedent for others junior to him....for others to emulate...
and infringement of discipline...which must apply to Generals in the Army too !

It is not understable why a person like such a big office files such petition almost during his verge of retirement. This is not a good example. If it was aught to be decided by the Hon'ble court and if the person concerned had a good intention, it could be done a long ago while he might have elapsed a pretty long time as his tenure of service. If the Hon'ble Supreme court dismiss the entire matter, it would be good to see especially in the eyes of Law probably. I do accept the verdict and hats off to the Hon'ble Court. Thanks and Regards.

I am of the opinion that this is a good decision by SC and this General has been cut down to size.
Earlier there was a similar case wherein a Brigadier Dutta of Army Service Corps (ASC) moved court in Jallundhar for rectifying his age and thus enhance his retirement age.
Army put forward a simple argument. "why this officer had not brought up the matter so far during his service.?" The Army even said that to bring this matter now on the verge of his retirement is tantamount to fraud as he is seeking benefit of getting promoted to the rank of Major General before retirement (and ensuing pensionary benefits!).
It was in today's TOI.
