Q.

In the Bofors deal it was a precondition that there will be no middlemen involved. But Quattrochi was a middleman and he was given a hefty commission. Now even if this fact has come to light ,I think all India could have done was to cancel the deal or file a case against Bofors.Under what legal clause can India try to prosecute Quattrochi as he is not involved directly with India. The commission he earned was from Bofors.kindly explain in layman's language as I am not a legal expert.Thanks.

You must first understand that commission is paid for all global deals ,whether in USA,UK or India. Bofors is one of such deals and commission was paid as usual. The point is Bofors guns are found to be good and cost the exchequer less than other guns etc. It is a mean case because it blows out . Such deals and commisions are happening each and everyday at the govt level,be it is BJP,CONGRESS or COMMUNISTS. I ,as a business man has paid such commission to the communist govt in Kerala.Bofors is a case which has no meaning and should have failed even it is probed and put in the court, any court and by any govt.

The commission received by a middle man , running to several tens of crore of Rupees in the Bofors, cannot be pocketed by him alone for the simple reason that a good percentage of the commission amount has to be given away to several politicians, bureaucrats and even members directly involved with the highpower tender committee and the technical evaluation committeee members like that That means, the decision for the purchase of a particular Howitzer was taken not entirely on merit but was influenced in favouring a different make, which was not on topp of the list It is common knowledge that whenever a middleman is involved in a deal, the decision of the authorities concerned is always influenced through this middleman What does it mean? The decision in favour of a particular product in manipulated through bribe So, the best product in quality and economies of scale take a back seat I remember that the then General of the Indain Army had recommended cancellation of the agree ...more

This simply means that the confgress is aiding and abbetting the crime.
It may also be a beneficiary of the bribe.
WHY SHOULD IT TAKE SO MUCH TROUBLE TO SHIELD THE CRIMINAL.
No one likes to be associated with criminals except a criminal.

Being an Indian, I respect your feelings. But, please dont forget that Red Corner notice on Quattrochi has been recently withdrawn and our Government is not able/ or not willing to book him under any law. As a result of this, he is now also allowed to withdraw the money from his bank accounts. Further, as far cancellation of Bofors contract is concerned, performance of Bofors is established in Kargil was and we can not ignore these equipments.
Like you, I am also not aware about the law but it is a fact which comes in a common man\'s mind.
