hi! FIRs are dealt by section 154 criminal procedure code. There is a statutory obligation on police to register FIR in cognigeble cases. If they failed to do so complaint can be sent directly to sp of police by rp. If no action is taken complaint can be filed in judicial first class magistrate court and then it will be forwarded to police. Then police are bound to register FIR and submit report to court.Otherwise penal action will be taken against police.
