The main Intellectual Property Rights include in conflicting areas of law as follows:-

1. Copyrights, which give the holder some exclusive rights to control some reproduction of works of authorship, such as books and music, for a certain period of time.

2. Patents give the holder an exclusive right to prevent third parties from commercially exploiting an invention for a certain period, typically 20 years from the filing date of a patent application.

3. Trademarks are distinctive names, phrases or marks used to identify products to consumers.

4. Trade secrets, where a company keeps information secret, perhaps by enforcing a contract under which those given access to information are not permitted to disclose it to others.

India is a signatory to the agreement establishing the World Trade Organization (WTO), which came into force on 1.1.95. The WTO Agreement, inter alia, contains an Agreement on Trade Related Aspects of Intellectual Property Rights (TRIPS) which prescribes the minimum standards to be adopted within stipulated time-frame by the member countries in respect of the following seven areas of intellectual property:

i. Copyright and related rights;
ii. Trademarks;
iii. Geographical indications
iv. Industrial designs;
v. Patents;
vi. Layout-designs (Topographies) of integrated circuits; and
vii. Protection of undisclosed information.
